OPINION

This case comes to the Court on plaintiff's motion for summary judgment and on defendants' motion to dismiss for lack of jurisdiction or in the alternative for failure to state a claim upon which relief can be granted, which can likewise be treated as a motion for summary judgment as provided by Rule 12(b), Fed.R.Civ.P.
