Pursuant to 21 U.S.C. § 174, appellant was indicted with David Gonzales on six counts charging the sale and concealment of heroin on July 28, 1966, August 29, 1966 and October 13, 1966. Appellant and Gonzales were tried separately and appellant was acquitted on the two counts relating to the July 28 transaction, but was convicted and sentenced on the four counts relating to the August 29 and October 13 transactions.
