MEMORANDUM OPINION

FULTON, Chief Judge.

The Plaintiffs, Mr. and Mrs. Vila, instituted this action against the United States for a refund of income taxes in the total amount of $723.89 for the years 1961, 1962 and 1963. They claim that said amount was collected from them erroneously in that the Commissioner disallowed their deduction for the loss of their rental properties which were allegedly confiscated by the Cuban Government after Plaintiffs became residents...
