Appellant Dan Garza, hereafter referred to as plaintiff, filed this suit against appellee Gilbert Perez d/b/a Jolly Roger Ice Cream, hereafter referred to as defendant, and one Tommie Dies, operator of the dump truck involved in the accident in question.
