STEPHENSON, Justice.

This is an action for damages for personal injuries sustained by plaintiff, Emmett O. Coleman. Trial was by jury, and judgment was rendered for defendant, Hudson Gas & Oil Corporation, non obstante veredicto, that plaintiff take nothing. The parties will be referred to here as they were in the trial court. This is the second appeal of this case, our first opinion appearing in Tex.Civ.App., 403 S.W.2d 482
