Appellee, James R. Kirkland, Jr., instituted this action as a "Claimant" seeking benefits under the Unemployment Compensation Act, Article 5221b-1, Vernon's Civil Statutes, and articles which follow. The Texas Employment Commission ruled that he was ineligible to receive benefits because he was not considered available for work within the meaning of the Act.
