Wainwright, was indicted on four counts for willfully attempting to evade federal income taxes for the years 1960, 1961, 1962, and 1963 in violation of Section 7201 of Title 26 United States Code.1 On motion for acquittal on all counts, the trial judge struck the count relating to 1960.
