This appeal is from a jury verdict and judgment against the plaintiff-appellant, Douglas P. Hobbs, in a battery action. Appellant alleged in his complaint that, in January, 1964, while detained by the Ada County sheriff's department, he was bludgeoned twice with a blackjack wielded by a deputy sheriff.
