NESBETT, Chief Justice.

Appellant's amended complaint questioning the legality of a bond election held by appellee Borough was dismissed with prejudice by the trial court for failure to state a claim upon which relief could be based and on the ground that the decision of that court in Dale v. Greater Anchorage Area Borough1 was res judicata.
