The petitioner, Frank E. Cota, was charged by information with first degree murder in the death of a state narcotics agent, one Roy Singh. Pedro Flores Valenzuela was charged in that same information as a codefendent. The first trial of petitioner and Valenzuela resulted in a mistrial.
