King & Sons, Inc., for personal injuries which Kempff sustained as a result of a fall from scaffolding allegedly owned, constructed and maintained by the defendant. Consolidated with this action is a suit by Kempff for workman's compensation benefits against Insurance Company of North America, the compensation carrier for plaintiff's employer Maritime Electric Company.
