TAYLOR, Circuit Judge.
In an action at law the circuit court of Volusia County, after jury trial, entered a judgment for the plaintiff. This judgment was reversed by the District Court of Appeal, First District, because the trial court did not grant a motion of the defendant to dismiss the case for lack of prosecution filed earlier in the proceedings.
