Roger Balderrama, the defendant, was indicted for refusing to submit to induction into the Armed Forces pursuant to an order of his local draft board, in violation of Title 50, United States Code App., Section 462(a).

Defendant filed a motion to dismiss the indictment, essentially on the grounds that his I-A classification was without basis in fact and was made on incorrect standards, and that the denial of a I-O classification was, therefore...
