OPINION

DWYER, Judge.

Wilburn E. Smith appeals from a conviction of murder in the first degree with a resulting sentence of confinement for ninety-nine years in the State Penitentiary. This verdict, as found, was returned by a jury in the Criminal Court of Hamilton County.

Defendant attacks the validity of the judgment entered against him and files assignments of error.
