OPINION

CHRISTIAN, District Judge.

In this action for damages for breach of contract, Playboy Rent-A-Car, Inc. (hereafter called Playboy) brought suit in the Municipal Court of the Virgin Islands, Division of St. Thomas and St. John, against its insurer The Continental Insurance Co. (hereafter called Continental) to recover sums expended by Playboy in defending a tort action brought against it by one Carlton Turnbull (hereafter called Turnbull).
