Defendant was charged with rape (Pen. Code, § 261, subd. 3); two prior convictions for burglary (Pen. Code, § 459), were alleged. Defendant pled not guilty; the prior convictions were admitted. Trial by jury was had; defendant was found guilty; probation was denied; defendant was sentenced to state prison for the term prescribed by law.
