In this case the Plaintiff sues the Defendants for the unpaid balance due on a promissory note dated July 22, 1960 and signed by the Defendants and others to the Plaintiff as payee. This note and another note, not sued on herein, were part of an over-all transaction in which the Plaintiff, the Defendants and others formed a company known as BGM Industries, Inc.
