ERBY L. JENKINS, Special Justice.

This suit involves an inverse condemnation action which was brought in the Circuit Court of Hamilton County, Tennessee. The trial court sustained defendant Hamilton County's plea in abatement and dismissed the action. The Court of Appeals, Eastern Section, reversed the trial court and remanded the case for trial on the merits. Certiorari was granted by this Court upon petition filed by Hamilton County.
