This diversity suit was instituted in the District of Colorado by appellee, Lucas, against appellant, Safeway Stores, Inc., to recover damages for personal injuries received by a fall in one of Safeway's retail stores in the Denver area. The case was tried to a jury and Lucas prevailed.
