Petitioner Herman Jackson is a twenty-seven year-old Negro who has been a prisoner for over seven years at the Florida State Prison under sentence of death for the crime of rape. Petitioner is lodged in the prison's maximum security area, the East Unit, which has a population of about 1,100 or one-third of the prison's population.
