This opinion is written upon reassignment. The suit is one by the widow of Loyd Turpin to recover damages for his wrongful death. The verdict and judgment were for the defendant. The death was caused by the discharge of a revolver held in the hand of the defendant, but it is merely contended that the shooting was negligent, and not intentional.
