On August 4, 1966, the plaintiffs commenced this action upon a promissory note executed by Mary Renzo and Tony Renzo and to foreclose a mortgage executed by Mary Renzo to secure payment of the note. Jesse Gallo and Lena Gallo intervened by leave of court, filed an answer and counterclaim against the plaintiffs wherein the Gallos claim that they are the holders of a prior mortgage executed by Mary Renzo.
