BURNETT, Chief Justice.

Bell was convicted of murder in the second degree and sentenced to serve not more than seventeen (17) years in the State penitentiary.

The only insistence made on this appeal is that plaintiff in error was twice put in jeopardy for the same offense. Under the factual situation presented in this case neither the counsel for plaintiff in error nor have we, after an independent research, been able to find another case...
