This is an appeal by Manuel Angel Estevez, from an order denying his motion to vacate, under Criminal Procedure Rule No. 1, F.S.A. ch. 924 Appendix, a previous sentence imposed upon him in a criminal case.

Defendant Estevez was charged in an information filed in the Criminal Court of Record for Hillsborough County with the offense of possession of burglarious tools. Upon trial, he was found guilty by a jury, and on August 9, 1965, was sentenced...
