Appellant, Maselli, and codefendant Weis were jointly tried and were convicted of murder in the first degree and burglary in the first degree. This court is herewith reversing Weis' conviction (People v. Weis, 30 A.D.2d 877), but is affirming Maselli's conviction. The victim of the crimes was Frances Olmstead, an elderly widow who lived alone...
