CRESON, Justice.

This is an appeal in error from a judgment in a workmen's compensation proceeding, rendered in the Circuit Court of Shelby County, Tennessee.

On March 8, 1966, the employer, Burlington Industries, Inc., and its insurance carrier, Liberty Mutual Insurance Company, filed this suit to determine the proper parties to receive the workmen's compensation benefits resulting from the death of an employee, Therman Terry. Named as defendants...
