OPINION

CRESON, Justice.

This suit is brought to recover privilege taxes paid under protest by the complainant-appellee, Robert Orr and Company. The Chancellor held that the complainant was not liable for the tax in question, and awarded recovery of the amount sued for. Review is sought by the State under the provisions of T.C.A. § 16-408 for direct appeal to the Supreme Court in State revenue cases.
