This consolidated action was tried before the court only as against the defendant, United States of America, under the provisions of the Federal Tort Claim Act, 28 U.S.C. § 1346(b). The other named defendant, James L. Meeks, admitted liability prior to the impanelling of a jury, and after the jury was qualified that portion of the case was passed for settlement, and the court was advised of the amount to be paid...
