A charge of aggravated robbery was filed against Martinez in 1961. Appearing without counsel, he originally pled not guilty by reason of insanity at the time of the alleged commission of the crime. Before entry of this plea, the defendant was advised he had a right to counsel and to receive the advice of counsel or that he could waive that right and enter a plea at that time if he desired.
