HARWOOD, Justice.

This appellant has been adjudged guilty of robbery, his sentence being fixed at forty years imprisonment in the penitentiary.

The evidence presented by the state tends to show that around 5:00 P.M., Monday, 30 December 1966, the appellant came into the shop of Charlie Howard Cleaners, located in Birmingham.
