The appellant, Dr. Isadore Levin, and his wife Miriam, filed suit on July 26, 1966, in the Circuit Court for Montgomery County. By amended declaration filed on August 31, 1966, they charged the appellees, the May Stores t/a The Hecht Company (Hecht Co.), and Walter Kidde & Company, Inc. (Kidde) with breach of warranty in one count and negligence in another. Kidde demurred to the amended declaration on the ground...
