A summary judgment rendered in favor of a third party defendant was the prelude to this appeal.

On June 25, 1964, an employee of the respondent while in the course of his employment was electrocuted when a drill rig he was operating came in contact with the appellant's power line. The deceased employee, Jacob Lesofski, had been employed by the respondent as a powder man to drill and blast rock in the construction of the highway....
