The petitioner, Henry Roy Russell, has taken his appeal here from the denial of his petition for a writ of habeas corpus by the Windsor County Court.

The petitioner is presently in the custody of the Warden of the Vermont State Prison for safekeeping by virtue of a warrant issued by the Governor of the State of Vermont, dated January 26, 1968.
