MEMORANDUM OPINION AND ORDER

REGAN, District Judge.

This is an action seeking relief from infringement of a trademark and related unfair competition. Defendants have asserted a counterclaim for unfair competition. Jurisdiction is grounded on the Lanham Act (15 U.S.C. Section 1116 et seq), 28 U.S.C. Section 1338, as well as on diversity of citizenship.
