These consolidated appeals involve the actions of two licensed real estate brokers, plaintiff, Theodore M. Barcelon, and E.S. Merriman & Sons, a corporation, to recover commissions on alleged agreements for their respective services to the buyer, defendant, Ross W. Cortese, president and agent of defendant, Rossmoor Corporation.

Barcelon and Merriman stipulated that each would be entitled to 50 percent of any judgment recovered by the other...
