This appeal stems from a personal injury action arising out of an altercation between patrons of the corporate defendant, Madison Tavern, which altercation occurred outside the tavern. The cause was tried to the court sitting without a jury and resulted in a judgment of dismissal. The plaintiff, feeling aggrieved, has appealed. The dispositive issue presented by the assignments of error is narrow and we outline the facts but briefly.
