Plaintiff brought this suit on October 7, 1965 against The Kansas City Southern Railway Company seeking recovery of damages sustained by plaintiff to its sugar cane crop as the result of a fire. By amendment to its petition plaintiff dismissed its suit against The Kansas City Southern Railway Company and substituted Louisiana & Arkansas Railway Company therefor as the sole defendant in the case.
