This is an appeal from a judgment of conviction of assault with a deadly weapon with intent to commit murder. (Pen. Code, § 217.)

In an information filed in Los Angeles on May 26, 1967, defendant was charged in count I with committing an assault with a deadly weapon upon Donald Johnson, on May 2, 1967, with the intent to murder the said Donald Johnson.
