BRETT, Judge:

Plaintiff in error, hereinafter referred to as defendant, was tried before a jury in the district court of Tulsa County, for the crime of larceny of an automobile. The jury returned a verdict of guilty, and imposed a sentence of eight years in the state penitentiary. Defendant's motion for new trial was overruled, and he was granted bail pending his appeal to this Court...
