This lawsuit arises by reason of a legislative oversight.

By PA 1960, No 44, effective April 19, 1960,1 water companies were added to the list of public utilities coming under the jurisdiction of the Michigan public service commission. Automatically, therefore, on April 19, 1960, every water company in Michigan was obligated to file its rates with the commission and obtain commission approval...
