SPENCER, Justice.

Defendant was convicted of murder in the first degree while attempting to perpetrate a burglary, and has perfected an appeal to this court.

Mae Ritchie, an 81-year-old woman, hard of hearing, and living alone on the outskirts of the city of Hastings, was found dead in her home about 9:35 a. m., December 10, 1966. She had last been seen alive around 9 o'clock Thursday morning, December 8, 1966....
