The appellant, Joseph Stassi, Sr., was convicted for violating Title 18, § 1621, United States Code. The indictment was in one count and charged essentially, that Stassi on January 26, 1966, falsely testified under oath as to a material matter before the United States Commissioner in the Southern District of Florida at Miami.
