On March 7, 1963, appellant was convicted of the first degree murder of his son and sentenced to death in a jury trial held in Pueblo County District Court, Pueblo, Colorado. This conviction was appealed to the Colorado Supreme Court and affirmed by that court in Segura v. People, 159 Colo. 371, 412 P.2d 227.
