SNELL, Justice.

This is an appeal from denial of plaintiff's petition for writ of habeas corpus.

Robert Hawkins pleaded guilty to murder in the first degree. He was sentenced to life imprisonment. After 40 years in the penitentiary he challenged the legality of his confinement. We have been furnished and have examined the records from Johnson County where he was sentenced and the records and transcript of the evidence...
