This is an appeal from a summary judgment denying appellant recovery against appellee in an action based upon a written contract of indemnity. Appellee defended, inter alia, on the ground that the agreement was to insure against liability only, and since such liability had accrued more than four years prior to the institution of suit, appellant's claim was barred by the provisions of Art. 5527, Vernon's Ann.Civ.St. of Texas.
