WEINFELD, District Judge.

The petitioner, James A. Thomas, upon his conviction of felonious possession of narcotics after a trial to the court without a jury in the Supreme Court, New York County, was sentenced on June 3, 1966 to a prison term of from five to ten years as a multiple felony offender. The judgment of conviction was affirmed by the Appellate Division,1 and leave to appeal to the Court of Appeals was denied...
