Plaintiff seeks workmen's compensation benefits for total and permanent disability resulting from an accident sustained while working for Rust Engineering Company. Defendant is the employer's insurer. The district judge found plaintiff totally and permanently disabled but denied penalties and attorney's fees. Defendant appealed.
