In Commonwealth v. Nassar, 351 Mass. 37, 44-45 (the first Nassar case1), we reversed Nassar's death sentence. He was again found guilty of murder in the first degree after a new trial, August 14-23, 1967. The new jury, however, recommended that the death sentence be not imposed. Nassar was sentenced to life imprisonment. The case is before us under G.L.c. 278, §§ 33A...
