RAWLINGS, Justice.

Acting pro se plaintiff, a state prisoner, sought original habeas corpus relief, and in like manner appeals from adverse judgment by trial court.

By virtue of the factual situation peculiar to the case at bar, we reverse.

Trial court granted plaintiff an evidentiary hearing without benefit of counsel. Then when appeal was taken his request for assistance of an attorney was denied, but what is designated as a transcript of proceedings...
