Defendant Ulysses Montague and co-defendant Clarence Lollie were indicted for assault and battery upon Newark police officer James Nance, in violation of N.J.S. 2A:90-4. Montague was also indicted for threatening the life of Officer Nance by pointing a revolver at him contrary to N.J.S. 2A:113-8. The jury found defendant guilty of both offenses and acquitted Lollie.
